Prince Harry’s Privacy Lawsuit Against Associated Newspapers is Dismissed by the London High Court

Prince Harry’s privacy lawsuit against Associated Newspapers, the publisher of the Daily Mail, was rejected by the UK High Court on Tuesday. The publication was sued by Harry and six other people, including musician Elton John, who claimed to have been the victims of illegal information collecting for stories. They accused Associated, which has denied any wrongdoing, of using methods including phone hacking and hiring private detectives to gather private and confidential information.

Mr. Justice Nicklin stated in a written ruling released on Tuesday that the claimants had “failed to prove their pleaded allegations” and that the court could not simply assume that material had been obtained illegally if there was still a possibility that it could have been obtained lawfully.Even when suspicion was reasonable, it was insufficient. According to the ruling, the claimants had to demonstrate that the material they were complaining about had been obtained illegally.

The Court rejected the argument that, simply because information was private, and because Associated could not positively explain how it had been sourced, the relevant article must have been unlawfully sourced” . Additionally, Nicklin claimed that “lawful explanations for the sourcing of the disputed articles and incidents” had been given by Associated journalists. Additionally, he rejected allegations that three top Associated executives had misled during the 2011–2012 Leveson Inquiry into the ethics, procedures, and culture of the British press.
